Privacybeleid

Certo is een app en webportaal voor HACCP- en keukenbeheer voor foodtrucks en horecazaken. In dit privacybeleid lees je welke persoonsgegevens we verwerken wanneer je onze website bezoekt of Certo gebruikt, waarom we dat doen, met wie we ze delen, hoe lang we ze bewaren en welke rechten je hebt. We houden het zo kort en duidelijk mogelijk.

1. Wie zijn wij

Certo wordt aangeboden door Peppino's (eenmanszaak), gevestigd aan Bisonspoor 2256, 3605 LR Maarssen, Nederland, ingeschreven bij de Kamer van Koophandel onder nummer 97585157, btw-nummer NL005280517B85 (hierna "Certo", "wij" of "ons").

2. Onze rol: verantwoordelijke of verwerker

De AVG (de Europese privacywet, ook GDPR genoemd) maakt een onderscheid tussen wie beslist over gegevens (de verwerkingsverantwoordelijke) en wie ze in opdracht verwerkt (de verwerker).

• Certo is verantwoordelijke voor de gegevens van websitebezoekers en voor de account-, contact- en facturatiegegevens van de zaken en gebruikers die Certo gebruiken.
• Certo is verwerker voor de gegevens die een zaak zelf in Certo invoert over andere personen, zoals de namen van medewerkers en klanten in logboeken en opdrachten. De zaak is daarvoor de verantwoordelijke. De afspraken daarover staan in onze gebruiksvoorwaarden (verwerkersovereenkomst).

3. Welke gegevens we verwerken

Accountgegevens

Je naam, e-mailadres, wachtwoord (enkel versleuteld/gehasht opgeslagen, wij kunnen het niet lezen), je rol binnen de zaak (eigenaar, manager of medewerker) en de datum waarop je account werd aangemaakt. Log je in met Sign in with Apple, dan ontvangen we van Apple een aanmeldtoken en je e-mailadres (of een anoniem doorstuuradres van Apple als je daarvoor kiest).

Gegevens van je zaak

Naam van de zaak, btw-nummer, KvK- of ondernemingsnummer, registratienummer bij de voedselveiligheidsautoriteit (zoals NVWA of FAVV), adres, telefoonnummer, website, contact-e-mailadres, naam van de verantwoordelijke, type zaak, je locaties en je abonnement. Een deel daarvan zijn bedrijfsgegevens, maar bij een eenmanszaak kunnen het ook persoonsgegevens zijn.

Inhoud die je zelf invoert

Alles wat je in Certo bijhoudt: opdrachten en dagrapporten, temperatuurmetingen, HACCP-controles, schoonmaak- en hygiëneregistraties, corrigerende acties, opmerkingen, de namen van medewerkers en klanten die je bij een opdracht invult, evenementen en locaties, voorraad, producten, recepten, allergenen, materiaal, geplande taken, boodschappenlijsten, omzet en kosten, gegenereerde PDF-rapporten en foto's die je toevoegt (bijvoorbeeld van producten of voedingsetiketten).

Facturatie

Zodra betaling actief is: je abonnement, facturen, factuuradres en btw-gegevens. Betaalgegevens zoals kaartnummers worden verwerkt door onze betaalprovider; wij slaan ze zelf niet op.

Technische gegevens

Wanneer je de website of de app gebruikt, verwerken onze hostingproviders technische gegevens zoals je IP-adres, het tijdstip, het type browser of toestel en foutmeldingen. Die gebruiken we enkel om de dienst te laten werken en te beveiligen. We gebruiken geen advertentie- of trackingtools en verkopen geen gegevens.

Contact en early access

Mail je ons of laat je je e-mailadres achter voor early access, dan gebruiken we dat adres om je te antwoorden of je te informeren over de lancering van Certo.

4. Wat op je toestel blijft

Certo werkt "lokaal eerst": je gegevens staan in de eerste plaats op je eigen iPhone, iPad of Mac, en worden gesynchroniseerd met onze cloud zodat je ze op meerdere toestellen en in het webportaal hebt. Sommige functies gebruiken toestemmingen van je toestel. Die gegevens komen niet bij ons terecht, tenzij hieronder anders staat:

• Face ID / Touch ID: wordt volledig door je toestel afgehandeld. Wij krijgen geen biometrische gegevens.
• Camera en fotobibliotheek: enkel om barcodes, kassatickets en etiketten te scannen of productfoto's toe te voegen. Alleen de foto's die je bewust toevoegt aan een product worden opgeslagen en gesynchroniseerd. Tekstherkenning (OCR) van tickets en etiketten gebeurt op je toestel.
• Agenda: Certo zet geplande taken in een "Certo"-agenda op je toestel. Synchroniseert je agenda via iCloud of Google, dan gebeurt dat door Apple of Google volgens hun voorwaarden.
• Siri, widgets en meldingen: werken lokaal op je toestel.
• Back-up en export: maak je een back-upbestand, dan bepaal jij waar je dat bewaart of naartoe stuurt.

5. Waarom we gegevens verwerken

6. AI-functies

Certo heeft enkele optionele functies die gebruikmaken van een AI-model van een externe AI-dienstverlener:

• Slimme ticketscan: de tekst die je toestel uit een kassaticket haalt (artikelnamen, aantallen, prijzen) wordt naar het model gestuurd om er een nette artikellijst van te maken. De foto zelf wordt niet verstuurd.
• Allergenenscan: namen van gerechten en ingrediënten, en de tekst van voedingsetiketten die je hebt gescand, worden naar het model gestuurd om mogelijke allergenen voor te stellen.

Die gegevens worden enkel verstuurd wanneer je zo'n functie zelf start, via onze eigen server (nooit rechtstreeks vanuit de app). Normaal bevatten ze geen persoonsgegevens; zet er dus ook geen in. Volgens de voorwaarden van die dienstverlener worden deze gegevens niet gebruikt om AI-modellen te trainen. De resultaten zijn voorstellen: jij kijkt ze na voor je ze overneemt.

7. Met wie we gegevens delen

We verkopen geen gegevens. We delen persoonsgegevens alleen met de volgende categorieën van ontvangers, en alleen voor zover dat nodig is:

• hosting- en clouddienstverleners (database, bestandsopslag, serverfuncties en de website, inclusief beveiliging en lettertypen);
• dienstverleners voor aanmelden en het versturen van dienstmails;
• een AI-dienstverlener, voor de AI-functies (zie punt 6);
• Apple, als je Sign in with Apple gebruikt of de app via de App Store of TestFlight installeert;
• een betaaldienstverlener, zodra betalingen actief zijn;
• overheden en andere instanties, als de wet ons daartoe verplicht.

Dienstverleners die gegevens voor ons verwerken, doen dat op basis van een verwerkersovereenkomst. Een actuele lijst van onze (sub)verwerkers krijg je op verzoek via certofoods@gmail.com.

Bij een overname of fusie kunnen gegevens overgaan naar de nieuwe eigenaar; dit privacybeleid blijft dan gelden.

8. Doorgifte buiten de EU

We bewaren de gegevens van Certo zoveel mogelijk in de EU. Sommige dienstverleners zitten in de Verenigde Staten. Gegevens gaan enkel naar landen buiten de Europese Economische Ruimte met passende waarborgen, zoals het EU-VS Data Privacy Framework of de standaardcontractbepalingen van de Europese Commissie.

9. Hoe lang we gegevens bewaren

• Account en inhoud: zolang je account actief is. Verwijder je iets in de app, dan wordt het ook uit de cloud verwijderd.
• Na beëindiging: je kunt je gegevens nog 30 dagen exporteren. Daarna verwijderen we ze. Kopieën in back-ups verdwijnen uiterlijk 90 dagen later.
• Facturen en boekhouding: zolang de wet dat vereist (in Nederland 7 jaar, de fiscale bewaarplicht).
• Technische logs: kort, doorgaans enkele dagen tot weken.
• Early access-inschrijving: tot de lancering of tot je je afmeldt.

Let op: de zaak die Certo gebruikt, moet HACCP-registraties zelf lang genoeg bijhouden voor controles door de voedselveiligheidsautoriteit (zoals de NVWA of het FAVV). Exporteer je gegevens (PDF of back-up) voor je je account verwijdert.

10. Beveiliging

We nemen passende technische en organisatorische maatregelen. Alle verbindingen zijn versleuteld (HTTPS/TLS). Wachtwoorden worden gehasht opgeslagen. Elke zaak ziet in de database enkel haar eigen gegevens, afgedwongen op serverniveau (row level security). Gevoelige sleutels, zoals die van de AI-dienst, staan enkel op de server en nooit in de app. Toegang tot productiegegevens is beperkt tot wie ze nodig heeft. Geen enkel systeem is 100% veilig: ontdek je een beveiligingsprobleem, meld het ons dan.

11. Jouw rechten

Je hebt het recht om:

• je gegevens in te zien en er een kopie van te krijgen;
• onjuiste gegevens te laten verbeteren;
• je gegevens te laten wissen;
• de verwerking te laten beperken;
• je gegevens in een gangbaar formaat mee te nemen (de export- en back-upfunctie in de app helpt daarbij);
• bezwaar te maken tegen verwerking op basis van ons gerechtvaardigd belang;
• je toestemming in te trekken, zonder dat dat de verwerking ervoor ongeldig maakt.

Mail daarvoor naar certofoods@gmail.com. We antwoorden binnen een maand. We kunnen je vragen je identiteit te bevestigen.

Ben je niet tevreden over hoe we met je gegevens omgaan? Dan kun je een klacht indienen bij de Autoriteit Persoonsgegevens, Postbus 93374, 2509 AJ Den Haag, www.autoriteitpersoonsgegevens.nl. Woon je in een ander EU-land, dan kun je ook terecht bij de toezichthouder van dat land (in België: de Gegevensbeschermingsautoriteit). We horen het liefst eerst van jou, zodat we het samen kunnen oplossen.

12. Cookies en lokale opslag

De website gebruikt geen tracking- of advertentiecookies en geen analysetools. In je browser slaan we enkel op wat nodig is om de site te laten werken: je taalkeuze (NL/EN) en, als je inlogt, je sessie. Onze hostingprovider kan strikt noodzakelijke cookies plaatsen om de site te beveiligen tegen misbruik. Voor deze functionele opslag is geen toestemming nodig.

13. Minderjarigen

Certo is bedoeld voor professioneel gebruik door ondernemingen en hun medewerkers. Je moet minstens 16 jaar zijn om een account te gebruiken.

14. Wijzigingen

We kunnen dit privacybeleid aanpassen, bijvoorbeeld als Certo nieuwe functies krijgt. De datum bovenaan toont de laatste versie. Bij belangrijke wijzigingen laten we het je vooraf weten per e-mail of in de app.

Privacy Policy

Certo is an app and web portal for HACCP and kitchen management for food trucks and hospitality businesses. This privacy policy explains which personal data we process when you visit our website or use Certo, why we do so, who we share it with, how long we keep it and what rights you have. We keep it as short and clear as we can.

1. Who we are

Certo is provided by Peppino's (sole proprietorship), located at Bisonspoor 2256, 3605 LR Maarssen, the Netherlands, registered with the Dutch Chamber of Commerce (KvK) under number 97585157, VAT number NL005280517B85 ("Certo", "we" or "us").

2. Our role: controller or processor

The GDPR distinguishes between whoever decides about personal data (the controller) and whoever processes it on their behalf (the processor).

• Certo is the controller for data about website visitors and for the account, contact and billing data of the businesses and users that use Certo.
• Certo is a processor for data that a business enters into Certo about other people, such as the names of staff and clients in logbooks and jobs. The business is the controller for that data. The arrangements for this are set out in our Terms of Use (data processing agreement).

Are you a staff member or client of a business that uses Certo and do you have a question about your data? Please contact that business first. We will help them handle it.

3. What data we process

Account data

Your name, email address, password (stored only in hashed form; we cannot read it), your role within the business (owner, manager or staff member) and the date your account was created. If you sign in with Sign in with Apple, Apple gives us a sign-in token and your email address (or an anonymous Apple relay address if you choose that option).

Business data

Business name, VAT number, company or Chamber of Commerce number, registration number with the food safety authority (such as the NVWA or FAVV), address, phone number, website, contact email, name of the person responsible, type of business, your locations and your subscription. Most of this is business data, but for a sole trader it can also be personal data.

Content you enter

Everything you keep in Certo: jobs and daily reports, temperature readings, HACCP checks, cleaning and hygiene records, corrective actions, notes, the names of staff and clients you enter for a job, events and locations, stock, products, recipes, allergens, equipment, scheduled tasks, shopping lists, revenue and costs, generated PDF reports and photos you add (for example of products or food labels).

Billing

Once payment is active: your subscription, invoices, billing address and VAT details. Payment details such as card numbers are processed by our payment provider; we do not store them ourselves.

Technical data

When you use the website or the app, our hosting providers process technical data such as your IP address, the time, your browser or device type and error messages. We use this only to run and secure the service. We use no advertising or tracking tools and do not sell data.

Contact and early access

If you email us or leave your email address for early access, we use that address to reply or to let you know when Certo launches.

4. What stays on your device

Certo is "local first": your data lives primarily on your own iPhone, iPad or Mac and is synced to our cloud so you have it on several devices and in the web portal. Some features use permissions on your device. That data does not reach us unless stated below:

• Face ID / Touch ID: handled entirely by your device. We receive no biometric data.
• Camera and photo library: only used to scan barcodes, receipts and labels or to add product photos. Only the photos you deliberately add to a product are stored and synced. Text recognition (OCR) of receipts and labels happens on your device.
• Calendar: Certo adds scheduled tasks to a "Certo" calendar on your device. If your calendar syncs via iCloud or Google, that is done by Apple or Google under their own terms.
• Siri, widgets and notifications: run locally on your device.
• Backup and export: if you create a backup file, you decide where you keep it or send it.

5. Why we process data

6. AI features

Certo has a few optional features that use an AI model from an external AI provider:

• Smart receipt scan: the text your device reads from a receipt (item names, quantities, prices) is sent to the model to turn it into a clean list of items. The photo itself is not sent.
• Allergen scan: names of dishes and ingredients, and the text of food labels you have scanned, are sent to the model to suggest possible allergens.

This data is only sent when you start such a feature yourself, through our own server (never directly from the app). It normally contains no personal data, so please don't include any. Under that provider's terms, this data is not used to train AI models. The results are suggestions: you review them before accepting them.

7. Who we share data with

We do not sell data. We only share personal data with the following categories of recipients, and only to the extent necessary:

• hosting and cloud providers (database, file storage, server functions and the website, including security and fonts);
• providers for sign-in and for sending service emails;
• an AI provider, for the AI features (see section 6);
• Apple, if you use Sign in with Apple or install the app via the App Store or TestFlight;
• a payment provider, once payments are active;
• authorities and other bodies, where the law requires it.

Providers that process data on our behalf do so under a data processing agreement. An up-to-date list of our (sub-)processors is available on request via certofoods@gmail.com.

In the event of an acquisition or merger, data may pass to the new owner; this privacy policy will continue to apply.

8. Transfers outside the EU

We keep Certo's data in the EU wherever possible. Some providers are based in the United States. Data is only transferred to countries outside the European Economic Area with appropriate safeguards, such as the EU-US Data Privacy Framework or the European Commission's standard contractual clauses.

9. How long we keep data

• Account and content: for as long as your account is active. If you delete something in the app, it is also deleted from the cloud.
• After termination: you can still export your data for 30 days. After that we delete it. Copies in backups are removed no later than 90 days afterwards.
• Invoices and accounting: for as long as the law requires (7 years in the Netherlands, under the tax retention obligation).
• Technical logs: briefly, usually a few days to weeks.
• Early access sign-up: until launch or until you unsubscribe.

Please note: the business using Certo must itself keep HACCP records long enough for inspections by the food safety authority (such as the NVWA or FAVV). Export your data (PDF or backup) before deleting your account.

10. Security

We take appropriate technical and organisational measures. All connections are encrypted (HTTPS/TLS). Passwords are stored hashed. Each business can only see its own data in the database, enforced at server level (row level security). Sensitive keys, such as the one for the AI service, are kept only on the server and never in the app. Access to production data is limited to those who need it. No system is 100% secure: if you discover a security issue, please let us know.

11. Your rights

You have the right to:

• access your data and receive a copy;
• have inaccurate data corrected;
• have your data erased;
• have processing restricted;
• take your data with you in a common format (the export and backup feature in the app helps with this);
• object to processing based on our legitimate interest;
• withdraw your consent, without affecting the lawfulness of processing before that.

To exercise these rights, email certofoods@gmail.com. We will reply within one month. We may ask you to confirm your identity.

Not happy with how we handle your data? You can lodge a complaint with the Dutch Data Protection Authority, the Autoriteit Persoonsgegevens, PO Box 93374, 2509 AJ The Hague, the Netherlands, www.autoriteitpersoonsgegevens.nl. If you live in another EU country, you can also contact the supervisory authority there. We would prefer to hear from you first, so we can sort it out together.

12. Cookies and local storage

The website uses no tracking or advertising cookies and no analytics tools. In your browser we only store what is needed for the site to work: your language choice (NL/EN) and, if you sign in, your session. Our hosting provider may set strictly necessary cookies to protect the site against abuse. This functional storage does not require consent.

13. Minors

Certo is intended for professional use by businesses and their staff. You must be at least 16 years old to use an account.

14. Changes

We may update this privacy policy, for example when Certo gets new features. The date at the top shows the latest version. We will let you know in advance by email or in the app about important changes.
